Status of Underground Injection Control Program Decision

EPA is public noticing and accepting comments on the revised draft permit.

Public Participation

On Sept. 14, EPA will hold an informal public meeting to answer questions from 6-7 p.m., followed by a formal public hearing from 7-8:30 p.m. at St. Mary’s Hannah Catholic School, 2912 W. M-113, Kingsley.

EPA will accept written comments until Sept. 27, 2011 (midnight postmark). Comments submitted in 2010 do not need to be resubmitted. You may submit supplemental comments. EPA will address all comments received during both comment periods.

Once EPA issues a final decision, people who submitted comments on the draft decision will have the right to petition the Environmental Appeals Board to review any condition of the final permit decision. See below for more information about the appeal process.

Team Completions, LLC
Team Completions, LLC operates this commercial underground injection well – the Weber 4-8 well – to dispose of brine (a heavily saturated salt solution) from oil and gas wells. Team Completions wants to inject what is known as “leachate,” non-hazardous liquid waste from landfills, into the Weber 4-8 well in addition to the brine.

EPA is making the Team Completions draft permit available for further comment because a section of the draft permit was omitted during the earlier comment period. The omitted section is titled “Commencing Injection,” which describes what Team Completions must do before getting authorization to inject waste. EPA’s first comment period closed in May 2010 following an April 2010 public hearing. Comments submitted in 2010 do not need to be resubmitted. Supplemental comments are permitted. EPA will address all comments received during both comment periods.

General Overview of UIC Permitting Process

The flowchart below shows the main steps that the Underground Injection Control program follows to process a permit application from start to finish. The steps identified are:

  1. Receive the permit application.
  2. Conduct a completeness review and technical evaluation.
  3. Make a draft decision, announce the draft decision and public comment period and accept public input by mail and at public hearing.
  4. Prepare responses to public comments.
  5. Issue final decision and distribute responses to public comments.
  6. If the final decision is appealed, process the appeal.
EPA is at step three of this process, as highlighted in the graphic below.

Appeal Process

To appeal an EPA decision to the Environmental Appeals Board, you must submit a petition to the board which must arrive at the Board's office within 30 days of the receipt of the notice of decision by those who have the right to appeal. Only issues that were raised during the public comment period are subject to review by the board. The petition must include: If you wish to request an administrative review by the Environmental Appeals Board, you must submit your request in writing. Please use the following addresses: The request will be timely if received at the Board's office within 30 days of the receipt of the notice of decision by those who have the right to appeal. For your request to be valid, it must conform to the requirements of Title 40 of the Code of Federal Regulations Section 124.19. This request for review must be made prior to seeking judicial review of any final permit decision.
