EPA finalizes clean air standards for industrial boilers, and certain incinerators, and non-hazardous secondary materials definition.
December 20, 2012 – EPA issued final changes to Clean Air Act standards for major and area source boilers and commerical/industrial solid waste incinerators. These adjusted standards will achieve extensive public health protections by reducing toxic air pollution, while increasing the rule’s flexibility and addressing concerns raised by industry and labor groups.

EPA Denies Petitions for Reconsideration of Sewage Sludge Incinerator Rules
April 18, 2012 – EPA issued a notice denying two petitions for reconsideration of its final new source performance standards and emission guidelines for sewage sludge incinerators. Both petitions failed to meet procedural tests for reconsideration as required under the Clean Air Act. In letters sent on April 6, 2012, EPA notified petitioners of the decision to deny the request for reconsideration.

December 2, 2011 - EPA issued proposed reconsiderations for rules to reduce emissions of air pollutants from existing and new Boilers and major and area source facilities, and from Commercial and Industrial Solid Waste Incinerators (CISWI). EPA also proposed revisions to the Non-Hazardous Secondary Material (NHSM) Rule.

EPA Announces Timeline for Reconsideration of Air Toxics Standards for Boilers and Certain Incinerators
June 24, 2011 - As part of a filing with the US Court of Appeals for the DC Circuit, the EPA has set a schedule for issuing updated air toxics standards for boilers and certain solid waste incinerators. To ensure that the agency's standards are based on the best available data and the public is given ample opportunity to provide additional input and information, the agency will propose standards by the end of October 2011 and issue final standards by the end of April 2012.

February 21, 2011 - EPA announces that it will “reconsider” certain aspects of the boiler and commercial/industrial solid waste incinerator (CISWI) rules. The sewage sludge incinerator rule is not part of the reconsideration. The final boiler and CISWI rules reflect reasonable approaches consistent with the requirements of the Clean Air Act. However, some of the issues identified in the comments on our April 2010 proposals raised difficult technical issues that the Agency believes would benefit from additional public involvement.

EPA Seeks New Timetable for Reducing Pollution from Boilers and Incinerators
December 7, 2010 - EPA filed a motion in the federal District Court for the District of Columbia, seeking an extension in the current court-ordered schedule for issuing rules that would reduce harmful air emissions from large and small boilers and solid waste and sewage sludge incinerators. The motion seeks additional time—until April 2012—to re-propose and finalize these standards. The additional time will allow us to address the significant issues raised in public comments in a new proposal, gain additional public comment and information, and finalize a rule that will be protective and legally defensible.
