     June 8, 2000  "EPA has denied a petition under section 21 of the Toxic Substances Control Act (TSCA) requesting that EPA take regulatory action under section 8 of TSCA that might have affected the HPV Challenge Program and the HPV test rule. Some of the petitioners have challenged this denial in Federal court."

     The first test plans and robust summaries received in the HPV Challenge Program are now available on the Internet for public review and comment. Both submissions are from consortia and concern categories, so they include information on multiple, related chemicals. They were submitted by the American Petroleum Institute on petroleum coke, covering 2 chemicals; and by the Silicones Environmental, Health and Safety Council on aminosilanes, covering 2 chemicals.

    The comment period on these two submissions will end on August 19, 2000. Substantive comments can be submitted electronically to the Agency using the "Submit Comments" button provided on the index page for each data submission. Robust summaries are highly technical documents that describe existing data on chemicals; test plans indicate briefly where these existing data are deemed to be adequate and how companies or consortia propose to fill any critical remaining data gaps.

    Companies and consortia participating in the HPV Challenge Program have been requested to defer new testing for 120 days after their test plans and robust summaries are posted to the Internet, in order to allow for public review and substantive comment, particularly including the identification of additional existing information that might contribute to filling critical data gaps without requiring testing.

     EPA has completed processing of letters received by the December 1, 1999, deadline for voluntary commitments to the HPV Challenge Program. The numbers reported in the February 3, 2000, press announcements by EPA, CMA, and Environmental Defense have been updated. 2,080 chemicals have been sponsored by 437 Companies and 155 Consortia either directly through the HPV Challenge or indirectly through the ICCA HPV Initiative. Extensive updates have been made to the following pages on the ChemRTK website:

     The Electronic Submissions page on the ChemRTK website has been updated to include information for companies and consortia to use in submitting Test Plans and Robust Summaries of existing data. It also provides a means for submitting that information. As information becomes available, this area of the website will also provide means for the public to review the submitted technical data and to offer substantive comments and additional test data that could address or eliminate the need for some projected SIDS testing.

     New HPV FAQ regarding sellng a share of a specific chemical or discontinuing operation of a specific chemical.

     Non-confidential information from the 1998 IUR reporting cycle is now available on the 1990 and 1994 HPV chemicals, indicating which companies reported manufacturing or importing those HPV chemicals during 1998.

     The search function for the The HPV Challenge Program Chemical List and the 1994 List of HPV Additions has been modified so that searches may now be performed on the Sponsor Commitment Status Column.

     Guidance on Developing Robust Summaries provides guidance on the technical information that is necessary to adequately describe an experiment or study for each of the SIDS endpoints in the U.S. HPV Challenge Program.

     The Agency sent additional guidance to all companies involved in the HPV Challenge Program concerning principles for program participants to observe with respect to animal welfare.

     EPA is holding a series of public meetings to involve stakeholders in the design and development of a voluntary program to test commercial chemicals to which children may have a high likelihood of exposure. The purpose of the voluntary testing program is to obtain toxicity data needed to assess the risk of childhood exposure to commercial chemicals. EPA is asking interested stakeholders to nominate individuals to participate in a discussion of one or more of the three issue areas. Anyone can submit nominations for an individual or individuals, including themselves, whom they feel could effectively represent a particular stakeholder interest, or other important perspective, related to the issues to be addressed.

     The Agency has prepared a series of  Fact Sheets on the ChemRTK Initiative. They are a convenient source of information on various aspects of ChemRTK, including the HPV Challenge Program and Children's Chemical Health Testing, and address issues ranging from animal welfare to voluntary participation in the HPV Challenge. These documents are in PDF format and will require the Adobe Acrobat Reader.

     The Use of Structure-Activity Relationships (SAR) in the High Production Volume Chemicals Challenge Program provides guidance for developing SAR arguments for using data on one or more well-characterized chemicals that are closely related ("analogs") to single HPV chemicals in the Challenge Program to estimate specific endpoint values for such HPV chemicals. The scientifically justifiable use of analog data reduces the number of tests to be conducted.

     Revised  Guidance for Development of Chemical Categories in the HPV Challenge Program offers advice on how companies could group chemicals with similar characteristics into categories, and then evaluate existing data and conduct testing to characterize the category without having to perform every test on each individual chemical within it.

     The Childrens' Health Chemical Testing area of the ChemRTK website has been extensively updated to report on the initiation of a stakeholder involvement process. EPA will use this process to gain input on the design and development of a voluntary testing program which will target chemicals to which children may be highly exposed and for which there are insufficient data for risk assessment. Additions to the website on this issue include:

    the Federal Register notice signed on August 20, 1999 announcing the stakeholder process;

    information on the first Stakeholder Meeting on September 22-23, 1999; the Facilitator's Convening Document for the meeting;

    a document containing Background Information on the effort; and

    a link to the website containing the reports of the Scientific Advisory Panel (http://www.epa.gov/pesticides/SAP/1999), which has been reviewing test battery recommendations to assess the effects of pesticides and other chemicals on childrens' health.


     Many people have raised concerns about animal testing and the HPV Challenge Program. You can download the Agency's Factsheet on Animal Welfare (PDF Format) to learn what the EPA is doing to avoid unnecessary testing and to reduce the use of animals.

The Agency expects this number to grow in the weeks and months ahead as more companies accept the Challenge to participate in this important Initiative.

     The HPV Company/Chemical List contains non-confidential information from reports filed under the 1990 and 1994 Inventory Update Rule (IUR) on the high production volume (HPV) chemicals included in the HPV Challenge Program. The files can be used to identify which companies reported that they manufactured or imported specific HPV chemicals in the United States in any amount over 10,000 pounds during each reporting period. Companies seeking to form consortia can use these files to identify other companies who manufacture or import identical or similar chemicals.

     Guidance on Searching for Chemical Information and Data. June 7, 1999. This guidance provides assistance to industry participating in the HPV Challenge Program in successfully locating existing test data on high production volume chemicals.

     1990 HPV Chemical List Revised - 5/20/99. The Agency has updated the HPV Challenge Program Chemical List to add an indicator of "2" to sixteen additional chemicals, as these chemicals are otherwise being handled under the OECD SIDS Program. Fourteen of these chemicals were selected in the latest phase of the OECD SIDS chemical selection process (Phase 7), completed in February, 1999. The remaining two chemicals were already in the SIDS Program but had not been identified on the previous HPV Challenge Program Chemical List.

     As of March 29,1999, 190 companies have committed to filling gaps in basic health and safety information for over 1100 high-production volume chemicals. This action comes in response to the Vice President's 1998 Earth Day Challenge to industry to expand the public's right-to-know about 2800 chemicals manufactured or imported in excess of one million pounds a year.

     HPV Chemical Human Health Testing: Animal Welfare Issues and Approaches proposes approaches which could be used to minimize and optimize animal usage when obtaining SIDS testing program data on HPV chemicals.

     Guidance for the High Production Volume (HPV) Challenge Program
    and Confidential Business Information     provides clarification to potential sponsors of chemicals under the HPV Challenge Program, as well as interested parties, regarding CBI claims.

     On Tuesday, March 2, 1999, Peter Robertson, the Deputy Administrator of the EPA, spoke at a press conference hosted by the Chemical Manufacturers Association (CMA) in Washington, DC to report on the progress of the HPV Challenge Program. "If there were any doubts about the ability of this partnership to bear fruit, today's announcement should put these to rest," Robertson said, applauding CMA's announcement that more than sixty of their member companies have stepped forward early -- almost two weeks in advance of the Agency's March 15 deadline -- to sponsor over 600 chemicals in the HPV Challenge Program. "The companies that have stepped forward today to publicly state their early commitment to the Challenge Program can take justified pride in their leadership. As you all know, March 15 is another important milestone in this program and we are confident that today's announcement will spur others to make their commitments to this program by that date." Noting the importance of the program as a whole, Robertson concluded, "Today is just the start. In just a few short years, we will have a complete set of baseline toxicity data for thousands of the most common chemicals in commercial use. Better information will mean better management of chemicals and of the potential risks they pose, and this is an improvement that will benefit all of us."     Two new technical guidance documents have been provided at www.epa.gov/oppt/chemrtk/guidocs.htm to assist potential participants in the HPV Challenge Program. The first is Guidance for Assessing Adequacy of Existing Test Data for identifying a minimum data set to initially characterize the hazard of an HPV chemical, and criteria and/or guidance for determining whether existing data meet the requirements set forth in this minimum data set. The second is Development of Chemical Categories in the HPV Challenge Program, which provides examples of category approaches used in the OECD SIDS program as well as general guidance on how sponsors could construct categories that are scientifically sound.
