In May 2011, Indiana passed SB 251, creating the Clean Energy Portfolio Standard (CPS). The program sets a voluntary goal of 10 percent clean energy by 2025, based on 2010 levels. In order to participate in the program, qualifying electric utilities must apply to the Indiana Utility Regulatory Commission (IURC). Participation in CPS makes utilities eligible for incentives in order to pay for the compliance projects. Only public utilities may participate in the program; municipally owned utilities, rural electric cooperatives, or electric cooperatives with at least one rural electric cooperative member may not participate in the program. Participating utilities must meet the following goals in order to stay in the program and continue receiving incentives: - Between January 1, 2013 and December 31, 2018, utilities must use an average of at least 4 percent qualifying clean energy - Between January 1, 2019 and December 31, 2024, utilities must use an average of at least 7 percent qualifying clean energy - Between January 1, 2025 and December 31, 2025, utilities must use an average of at least 10 percent qualifying clean energy |

Eligible technologies include wind, solar energy, agricultural wastes and residues, waste heat recovery from capturing and reusing the waste heat in industrial processes for heating or for generating mechanical or electrical work, natural gas that displaces electricity from coal, and net metered distributed generation facilities. 50 percent of of qualifying energy obtained by Indiana utilities participating in the CPS to come from within the state. Utilities may trade Clean Energy Credits, which are defined as 1 megawatt of clean energy (as defined above). The IURC adopted rules (RM #11-05) in December 2011, which took effect January 1, 2012. Approved applications must report annually on March 1 beginning in 2014. |
