Additional Information Virginia's net-metering law applies to residential generating systems up to 10 kilowatts (kW) in capacity and non-residential systems up to 500 kW in capacity. Prior to 2006, net metering applied only to systems that generate electricity using solar, wind or hydro resources. In 2006, eligibility was extended to all systems that generate electricity using renewable energy, defined as "energy derived from sunlight, wind, falling water, sustainable biomass, energy from waste, wave motion, tides, and geothermal power." Lease financing for net-metered systems is also allowed. Net metering is available on a first-come, first-served basis until the rated generating capacity owned and operated by customer-generators reaches 1% of an electric distribution company's adjusted Virginia peak-load forecast for the previous year. Monthly net excess generation (NEG) is carried forward to the next month. This credit may not exceed the amount of energy purchased during the previous annual period. At a net-metered customer's request, the utility is required to enter into power purchase agreements with the customer.
