Summary
The U.S. Environmental Protection Agency (EPA), Region 5 is providing this notice of its intent to file a Proposed Consent Agreement and Final Order (Proposed CAFO) against Pri Mar Petroleum, Inc. resolving Spill Prevention, Control, and Countermeasure violations at facilities in St. Joseph, Niles, and Bangor, Michigan, in violation of Section 311(b)(3) of the Clean Water Act (CWA), 33 U.S.C. § 1321(b)(3). Pri Mar Petroleum, Inc. agreed to pay a civil penalty of $104,500 to the Oil Spill Liability Trust Fund.
Pri Mar Petroleum, Inc.’s Spill Prevention, Control, and Countermeasure violations at its three facilities included: failing to ensure adequate secondary containment structures for the facilities’ bulk storage containers or oil-filled equipment, failing to properly implement Spill Prevention, Control, and Countermeasure Plan requirements including those for discharge or drainage controls, failing to demonstrate necessary tank integrity, and failing to provide requisite inspections and trainings.
