In response to the FY2008 Consolidated Appropriations Act (H.R. 2764; Public Law 110–161), EPA issued the Mandatory Reporting of Greenhouse Gases Rule (74 FR 56260) which requires reporting of greenhouse gas (GHG) data and other relevant information from large sources and suppliers in the United States. The purpose of the rule is to collect accurate and timely GHG data to inform future policy decisions. In general, the Rule is referred to as 40 CFR Part 98 (Part 98). Implementation of Part 98 is referred to as the Greenhouse Gas Reporting Program (GHGRP).
Suppliers of certain products that would result in GHG emissions if released, combusted or oxidized; direct emitting source categories; and facilities that inject CO2 underground for geologic sequestration or any purpose other than geologic sequestration, are covered in Part 98. Facilities that emit 25,000 metric tons or more per year of GHGs are required to submit annual reports to EPA. Part 98 was published in the Federal Register (www.regulations.gov) on October 30, 2009 under Docket ID No. EPA-HQ-OAR-2008-0508-2278.
Latest Developments
On May 11, 2012, U.S. EPA proposed to make revisions and clarifications to the Greenhouse Gas Reporting Rule to facilitate implementation of the Greenhouse Gas Reporting Program (GHGRP). EPA is amending and clarifying certain terms and provisions within Subpart A (General Provisions); Subpart L (Fluorinated Gas Producers); Subpart W (Petroleum and Natural Gas Systems); and Subpart TT (Industrial Waste Landfills) to clarify rule provisions, modify specific provisions to address concerns raised by reporters, and correct errors. The minor amendment to subpart A aligns the definition of heat transfer fluids found in subpart I (Electronics Manufacturing) with the annual emissions reporting requirements in subpart A. The proposed amendments are not anticipated to place additional requirements on reporters and do not significantly change the monitoring and calculation methodologies. Corrections and clarifications made in this action will be helpful to owners and operators of facilities subject to the upcoming September 28, 2012 reporting deadline. More Information.
On April 16, 2012, EPA released an interactive training presentation covering the general requirements of the Greenhouse Gas Reporting Program (GHGRP). Intended for all audiences, the online training is enhanced with voiceover narration, and comprises five informational modules:

- Subpart HH: Municipal Solid Waste Landfills

On March 19, 2012 EPA extended the comment period until April 9, 2012 for a proposal to determine which data elements reported under subpart W of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). More information.
On February 24, 2012, EPA issued a proposal to determine which data elements reported under subpart W of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in September 2012. In addition, this action proposes to defer the deadline for reporting some recently added subpart W data reporting elements that are “inputs to emission equations” until 2015. More information.
On February 22, 2012, EPA updated the Greenhouse Gas Reporting Program (GHGRP) data publication tool to reflect revised data submitted by facilities in the December 17th – February 10th time frame . EPA also made other improvements to the data publication tool, including adding features to perform new queries of the data.
In addition, two new GHGRP data sets are being released and may be found on the GHGRP data downloads page. The first data set includes non confidential data elements provided by reporters and is available in XML format. The types of data elements provided in this file include methods used by the facilities to estimate their emissions, unit level data (if this data is non-confidential) and other facility-specific data. The second file contains the name and location of each facility's highest-level United States parent company or companies, as reported to EPA.

On February 22, 2012, EPA issued a proposal to determine which data elements reported under subpart I of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in September 2012. In addition, this action proposes to amend subpart I to remove the requirement that facilities that use best available monitoring methods (BAMM) recalculate the previous reporting years' emissions and resubmit them to EPA. On February 22, 2012, EPA also issued a final action to amend the Electronics Manufacturing source category of the Greenhouse Gas Reporting Rule, part 98. More specifically, EPA finalized amendments to the definition of fluorinated heat transfer fluids (HTFs) and to the provisions to estimate and report emissions from HTFs. EPA is finalizing these changes to reflect the Agency's intent to cover all fluorocarbons (except for ozone depleting substances regulated under EPA's Stratospheric Protection Regulations at 40 CFR Part 82) that can enter the atmosphere under the conditions in which HTFs are used in the electronics manufacturing industry. For the first time, comprehensive greenhouse gas (GHG) data reported directly from large facilities and suppliers across the country are now easily accessible to the public through EPA's GHG Reporting Program. The 2010 GHG data released on January 11, 2012 includes public information from facilities in nine industry groups that directly emit large quantities of GHGs, as well as suppliers of certain fossil fuels and high global warming gases. Data that must be reported once under Subpart L, section 98.126(a) and (f) should be included as part of the RY 2011 annual report, due September 28, 2012. More Information.
With the completion of EPA’s scheduled maintenance outage, the electronic Greenhouse Gas Reporting Tool (e-GGRT) is now available for the 2011 Reporting Year. Facilities and Suppliers subject to EPA’s Greenhouse Gas Reporting Program (GHGRP) may now begin entering their RY2011 data into e-GGRT by logging in at https://ghgreporting.epa.gov.
REMINDER: If you submitted a GHG report for reporting year 2010 and you will not be reporting on any of the new 2011 source categories (PDF, 1 pg, 44K), then your report is due by April 2, 2012. An overview e-GGRT webinar that covers data entry changes from Reporting Year 2010 (RY2010), data that will carry over into the 2011 forms, and other helpful information, was held on February 28, 2012 (PDF) (12 pp, 724K). If you are required to report for any of the new 2011 source categories, then your report is due on September 28, 2012. You must be registered in e-GGRT by July 30, 2012. However, if you are required to report for any of the new 2011 source categories AND if your facility submitted a GHG annual report for reporting year 2010 under another subpart (e.g., stationary fuel combustion), then by April 2, 2012 you must notify EPA through e-GGRT that you are not required to submit the second annual report until September 28, 2012. The reporting deadline extension applies to all subparts being reported by the facility or supplier.
Reporter registration is a necessary first step in meeting your GHG reporting obligations. The e-GGRT registration module is available at ghgreporting.epa.gov.
