Pesticide News Story: Comment Period Opens on Proposed Rule to Define a Prion as a Pest under FIFRA

EPA is proposing an amendment to existing regulations to implement the 2003 decision that a prion (proteinaceous infectious particle) is a “pest” under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).

This proposed rule would codify the Agency’s current interpretation of FIFRA, and provides interested parties the opportunity to comment on amending the regulations at 40 CFR Part 152.5 to specifically add “prion” to the list of pests. Comments on the NPRM will be accepted until March 28, 2011.
