Regulation of Fuels and Fuel Additives - Modifications to Renewable Fuel Standard Program Requirements

The U.S. Environmental Protection Agency (EPA) is taking final action to amend the current Renewable Fuel Standard program requirements, which took effect on September 1, 2007. Following publication of the final Renewable Fuel Standard regulations in May 2007, EPA discovered a number of technical errors and areas within the regulations that could benefit from clarification or modification. EPA then published a direct final rule that amended the regulations to make the appropriate corrections, clarifications and modifications. However, EPA received adverse comment on several provisions in that direct final rule, and therefore withdrew those provisions. In this action, EPA is addressing the adverse comments received and finalizing those withdrawn provisions in order to provide clarification of the Renewable Fuel Standard.

This action does not address changes to the Renewable Fuel Standard program called for under the Energy Independence and Security Act of 2007. Today’s action addresses only technical errors and areas requiring minor clarifications or modifications in the existing Renewable Fuel Standard program regulations.
