On July 27, 2007, EPA published a proposed rule in the Federal Register  (72 FR 41246) to approve a state implementation plan (SIP) submitted by the State of Pennsylvania. EPA’s adequacy review of the motor vehicle emissions budgets and an opportunity for public comment on the SIP revision are being done concurrently. San Joaquin Valley, California, PM10 attainment (2005 budget) and maintenance plan (2020 budgets)

On April 25, 2008, EPA published a proposed rule in the Federal Register | PDF Version (12 pp) (73 FR 22307) to approve a State Implementation Plan (SIP) revision submitted by the State of California. EPA’s adequacy review of the motor vehicle emissions budgets and an opportunity for public comment on the SIP revision are concurrent. EPA is proposing approval of the revision to the SIP in accordance with the requirements of the Clean Air Act.

South Coast Air Basin, California, 8-hour ozone reasonable further progress and attainment plan

The State of California has requested that EPA parallel process the proposed SIP revision for adequacy, meaning that we will start the public comment period for the adequacy of the SIP prior to the State completing its SIP adoption process. Specifically, as described below, ARB has proposed modifications to the motor vehicle emissions budgets associated with the SIPs for the 1997 8-hour ozone air quality standard. As in every adequacy review, the public has 30 days to comment on the adequacy of this SIP. Should there be any significant changes to the SIP when the State formally submits the final version to EPA, we will restart the 30 day public comment period for adequacy. However, if the State submits the current proposed SIP as the final version to EPA, there will not be another comment period before EPA makes its adequacy finding.

The State has asked EPA to review two sets of transportation conformity budgets for this SIP.

The State has asked EPA to review a “SIP-based budget path” that is consistent with the 8-hour ozone attainment and reasonable further progress (RFP) demonstrations submitted to EPA on November 28, 2007. However, the newly proposed budgets are not identical to the budgets in the November 2007 submission. These budgets have been modified in two ways. First, emissions reductions attributable to the State’s strategy have been removed from the 2008 8-hour ozone motor vehicle emissions budgets. Second, EMFAC2007 was used to calculate the emissions as opposed to the South Coast Air Quality Management District’s CEPA emission factor model that was used in the November 2007 submission. EPA approved the EMFAC2007 model for SIP purposes on January 18, 2008 (73 FR 3464). The proposed SIP revision includes “SIP-based budgets” for the following RFP years:  2008, 2011, 2014, 2017, and 2020, as well as the attainment year of 2023.

The State has also asked EPA to review a “baseline budget path” that reflects emissions reductions from rules that were adopted as of October 2006. The “baseline” budgets do not include emissions reductions from the State’s strategy as reflected in the November 2007 SIP submittal. These motor vehicle emissions budgets are also calculated using EMFAC2007. The proposed SIP revision includes baseline motor vehicle emissions budgets for the following RFP years: 2008, 2011, 2014, 2017 and 2020.

The State requests that EPA give primary consideration to the “SIP-based” budgets in its adequacy review, and find the “baseline” budgets to be adequate if it cannot find the “SIP-based budgets” adequate in their entirety.

These revised 8-hour ozone motor vehicle emissions budgets replace the budgets previously submitted to EPA and posted on EPA’s adequacy review webpage on February 12, 2008. EPA is re-starting its adequacy public comment period on both sets of the proposed revised budgets. In its current adequacy review of the budgets, EPA also will consider any relevant public comments submitted on the original budgets.
