Proposal to Find Missouri Lead Plan Substantially Inadequate, Doe Run Company, Herculaneum, Missouri

INTRODUCTION

EPA Region 7 invites the public to review and comment on a proposal to find that the Missouri State Implementation Plan (SIP) for lead is substantially inadequate to attain the National Ambient Air Quality Standard (NAAQS) in Herculaneum, Mo. Herculaneum was designated nonattainment for lead in 1991 under authorities provided by the Clean Air Act Amendments of 1990.

BACKGROUND

Doe Run-Herculaneum has violated the National Ambient Air Quality Standard for lead in three consecutive calendar quarters of 2005. The company and the Missouri Department of Natural Resources (MDNR) operate monitors at the Broad Street monitoring location.

The standard for lead is set at a level of 1.5 micrograms of lead per cubic meter of air, averaged over a calendar quarter. Doe Run’s monitor recorded a quarterly value of 1.928 micrograms per cubic meter in the first calendar quarter of 2005, and MDNR’s monitor recorded a quarterly value of 1.877. Doe Run’s monitor recorded a value of 1.615 in the second quarter, and MDNR’s monitor recorded a value of 1.60 in the third quarter.

MDNR will be required to revise its SIP to correct these deficiencies if EPA finalizes the proposed finding of substantial inadequacy.

EPA PROPOSED ACTIONS

EPA is seeking comment on the following proposed actions relating to the Missouri SIP for lead for the Herculaneum nonattainment area:

EPA proposes to find that the SIP is substantially inadequate to attain and maintain the NAAQS for lead in the area;

EPA proposes to require that Missouri revise the SIP to meet all the applicable requirements of section 110 and part D of Title I of the Clean Air Act with respect to lead in the area;

EPA proposes to require the state to submit revisions to the SIP within 12 months of the final rulemaking; and

EPA proposes to require that the SIP provide for attainment of the lead NAAQS in the Herculaneum nonattainment area as expeditiously as practicable, but no later than two years after issuance of a final action on this proposal.

ADDITIONAL INFORMATION

A Federal Register notice about the proposal was published Dec. 19, 2005. Publication of this notice began a 30-day public comment period, ending Jan.18, 2006. Comments must be received on or before this date.
