Proposed Decision to Renew Hazardous Waste Permit, McConnell Air Force Base, Wichita, Kansas

INTRODUCTION

The U.S. Environmental Protection Agency (EPA) Region 7 invites the public to comment on the proposed Part II Resource Conservation and Recovery Act permit renewal for the McConnell Air Force Base in Wichita, Kansas.

The public comment period will start on June 11, 2007, and end on July 27, 2007. All written comments must be sent to the address below. EPA will hold a public availability session so community members can ask questions about the proposed Part II permit renewal. See section below for details.

BACKGROUND

McConnell Air Force Base is an active United States Air Force installation and operates KC-135R refueling aircraft. The facility is located at 2801 South Rock Road in Wichita.

EPA and KDHE first issued the permit to the facility in November 1993. The permit has two parts. Part I, issued by KDHE, allowed for hazardous waste storage. Part II, issued by EPA, required cleanup actions at a number of on-site contaminated areas. KDHE is only authorized to issue Part 1.

KDHE determined that McConnell Air Force Base no longer conducted hazardous waste storage activities which required a permit, thus effectively terminating the Part I permit. Permits are effective for 10 years and are automatically extended on a temporary basis if not renewed before the 10-year period.

PART II PERMIT RENEWAL

EPA intends to renew and update Part II of the permit so continued cleanup can take place at the contaminated areas. The draft Part II permit has been changed to include newly-discovered contaminated areas, additional regulations and requirements, and clarified language from the original permit.

ADDITIONAL INFORMATION

EPA encourages the public to review and comment on the proposed Part II permit renewal. Written comments should be submitted by July 27, 2007. The administrative record is available at the following locations:

EPA has not scheduled a formal public hearing. One will be held if there is sufficient public interest or to clarify relevant issues. Request for a public hearing must be made in writing to the EPA contact listed on page 1 and must state the issues of concern.

EPA will make a final decision to renew Part II of the permit only after the public comment period ends and all comments are reviewed. Notice will be given to the applicant, all persons who submitted written comments, those who commented at the public availability session, and those who requested notice of the final permit decision. The permit will become effective immediately upon its issuance if none of the comments received during the public comment period request revisions to the draft permit. If comments received during the public comment period request revisions, the permit will become effective 30 days after service of notice of the final decision or at a later date if a review is requested.
