Determination of Corrective Action Complete Without Controls at the IBP, Inc. Facility, Lexington, Dawson County, Nebraska

INTRODUCTION

The U.S. Environmental Protection Agency (EPA) Region 7 invites the public to review and comment on EPA’s tentative determination that corrective action is complete at the IBP, Inc. facility, EPA ID NED072892037, located at 1500 Bridge Street in Lexington, Dawson County, Nebraska. 

Based on the completion of corrective action activities and absence of residual contamination above unrestricted use cleanup levels, EPA is proposing to issue a determination of “Corrective Action Complete without Controls” for the facility. 

Corrective Action Complete without Controls means that Corrective Action Objectives (CAOs) have been met and the areas subject to the determination do not require any additional actions or measures to ensure that the remedy remains protective of human health and the environment.  Cleanup objectives based on current and reasonably expected future land use, including residential use, have been met.

Background and Actions

In 1974, Sperry-New Holland built a manufacturing plant to produce mechanized farm equipment. Production and finishing processes used chemicals such as acid and base wash solutions, cutting oils, paints, and solvents. The plant also stored and used diesel fuel and kerosene. Unisys Corporation, formerly Burroughs Corporation, merged with Sperry, and continued to operate the facility until March 1986. In 1988, Unisys sold the site to IBP, Inc. (now Tyson Foods) for use as a beef processing plant. 

Construction activities occurring at the facility around 1990 led to the discovery of potential soil contamination from leaking underground storage tanks (USTs) at the site. 

In 1992, EPA and IBP/Unisys entered into a RCRA 3008(h) Administrative Order on Consent to conduct a four-phased corrective action program.  It included:

Interim Measures implemented during the mid 1980s included operation of the xylene groundwater extraction system to immediately reduce the spread of hazardous wastes into the environment by reducing source area contamination.

The RFI, initiated in 1994, determined that three areas required further investigation: the former Paint Storage Area, the former Diesel/Kerosene UST Area, and the former Xylene UST Area. The CMS, completed in 1997, developed objectives to protect human health and the environment for all future land uses, including residential. The following contaminants of concern were identified: benzene, 1,1-dichloroethane, 1,2-dichloroethene, xylene (total), ethyl benzene, toluene, 1,1,1-trichoroethane, naphthalene, trichloroethylene, 2,4-dimethylphenol, 2-methylnaphthalene, arsenic, barium, chromium, and lead.

Final remedies for clean up of soil and groundwater contamination were selected in November 1998.  The final remedy required:

The facility implemented the final remedies and by October 2005, reached the clean up levels established in the final remedy for all contaminants of concern in soil and groundwater.

EPA believes that it is important to provide meaningful opportunity for public participation as part of a completion determination procedure.  The community is encouraged to review the Administrative Record and comment on EPA’s tentative decision.

 A formal public hearing has not been scheduled for these actions, but will be held if there is sufficient public interest.

Requests for a public hearing must be made in writing to Ruby Crysler, the EPA contact, and must state the nature of issues to be raised at the hearing.  EPA will evaluate any request and hold a formal hearing, if it finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the determination of corrective action complete without controls.
 
The comment period begins December 31, 2008 and ends March 30, 2009.
Comments or requests should be submitted prior to March 30, 2009.

EPA will approve or deny the determination of corrective action complete only after the public comment period has ended and all comments have been reviewed.
