The continuous release reporting regulation in Section 103(f)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) allows for reduced reporting requirements for facilities that release hazardous substances at levels that equal or exceed their reportable quantities (RQ) over a 24 hour period. For a facility to be eligible to report under the continuous release exemption, the facility must provide sufficient information to establish that their chemical releases are discharged in a continuous, stable and predictable manner. Under the CR-ERNS rule, eligible facilities are required to submit an initial emissions report and a one-year follow-up report. No other reporting is required unless a statistically significant increase in the emissions occur. Each year Region VIII conducts onsite inspections to gather additional information to determine risks from facility's continuous releases and to ensure compliance with the requirements of the continuous release program.

Program Components
• Initial telephone and one-time, first anniversary written follow-up reports required
• Facilities supply notifications of their releases to the NRC, SERC's and LEPC's
• Facilities evaluate their yearly emissions for reporting statistical significant increases
• Written notification of changes in ownership
• Results in reduced reporting requirements for facilities and the man-hours to required to evaluate the effects of their releases
