Pesticide Container and Containment Rule

The Pesticide Container and Containment Rule establishes requirements for pesticide container design and procedures, standards and label language to facilitate removal of pesticides from containers prior to disposal or recycling. The rule also establishes requirements for containment of stationary pesticide containers and procedures for container refilling operations.

EPA issued a final rule on June 15, 2010 that extends the compliance date for container and containment labeling requirements from August 16, 2010, to December 16, 2010. This extension will allow more time for us to complete the public participation processes for a proposed one-year extension for the compliance date. The four-month extension will become effective on August 16, 2010, after a 60-day congressional review is complete as required by federal law.

The resources provided below are intended to be used as a guidance tool to help regulators and the regulated community, refillers (e.g., producers or repackagers), retailers, commercial applicators and custom blenders identify and comply with the requirements of the Container and Containment Rule per the authority given by the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), Section 19(e) and (f), and its implementing regulations at 40 Code of Federal Regulations, Section 165.

This tri-fold brochure provides updated dates for each component of the rule and describes the requirements needed for secondary containment units, containment pads, refillable containers, repackaging, and container labels.  Please note that the compliance date for the labeling requirements has been extended to December 16, 2010 and there is a pending regulation change that could extend it to August 16, 2011.
