EPA Activities in Kettleman City Area

Current PCB Renewal/Expansion Application

Permit

EPA is currently reviewing CWM’s permit applications.  EPA recently issued a Notice of Deficiency to CWM for these applications, requesting additional information.  The agency is also consulting with the U.S. Fish and Wildlife Service’s regarding the facility’s impact to endangered species.  Additionally, EPA is consulting with the State Historic Preservation Officer regarding the facility’s impact to archeological resources.

EPA intends to act upon the renewal and modification TSCA PCB permit applications simultaneously.  Once a proposed permitting decision on CWM’s applications has been made, EPA will provide a public notice in advance.  In addition, EPA will hold a public meeting to announce our proposal and provide for the opportunity for a public question and answer workshop, as well as open a 60-day period for the public to formally comment.  A formal public hearing will also be held to take comments on the proposed decision.

As previously stated, EPA will ensure the facility is in compliance prior to continuing our permit application review.  The state and EPA will continue to regularly inspect and monitor compliance at the facility and take all information into account as a part of our proposed permit decision.  As with all operating facilities, if EPA ever found violations that posed a risk to human health, we would use our authority to take whatever action necessary to address that risk.
