Record of Decision Amendment Issued - Cherokee County Superfund Site, Cherokee County, Kansas, Baxter Springs and Treece Subsites

INTRODUCTION

The U.S. Environmental Protection Agency (EPA) has released a Record of Decision (ROD) Amendment that addresses the remaining non-residential mine waste that impacts the Baxter Springs and Treece areas. Some of the mine waste in these areas was addressed in a prior environmental cleanup. This action is being taken under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), also known as the Superfund law. The ROD Amendment was signed on September 29, 2006.

A public comment period ran from July 24 to August 22, 2006. EPA took comments on the Proposed Plan (the plan that lists cleanup options) electronically, by mail, by fax, and at a public meeting which was held on Thursday, August 10, 2006 at the Baxter Springs Community Center. EPA recommended actions in the Proposed Plan for addressing the remaining mine waste.

After the public comment period closed and EPA reviewed and summarized all comments, a remedy was selected. The ROD Amendment includes a summary of EPA's responses to comments received during the public comment period.
