àSix€commenters€alleged€that€section112(e)€contains€noÏprohibitions€against€the€EPA€changing€the€schedule.€€One€of€theÏcommenters€interpreted€the€absence€of€such€prohibition€to€meanÏthat€the€decision€has€been€left€to€the€EPA's€discretion.€€TheÏcommenter€argued€that€Congress€would€have€firmly€indicated€thatÏthe€EPA€would€not€have€the€authority€to€adjust€the€regulatoryÏschedule€if€Congress€had€so€intended.€€Finally,€the€commenterÏasserted€that€if€the€EPA€was€deprived€of€its€authority€to€adjustÏthe€schedule,€the€revision€authority€described€in€sections112(b)Ïand112(c)€would€lose€much€of€its€value.€€Others€added€that€sinceÏsection112(e)€is€not€considered€a€rulemaking€subject€to€judicialÏreview,€the€EPA€should€not€be€pressured€regarding€revisions€toÏthe€schedule€by€possible€lawsuits€or€the€requirements€of€theÏAdministrative€Procedure€Act,€5U.S.C7551€(1992).€€However,€oneÏcommenter€stated€that€the€schedule€should€not€be€altered€unless€aÏsignificant€change€in€the€ranking€of€source€categories€occursÏbased€on€the€changing€state€of€knowledge€supporting€the€threeÏcriteria€used€in€establishing€the€schedule.Ìà  àIn€response€to€the€above€comments€on€flexibility,€the€EPAÏinterprets€section€112€of€the€1990€Amendments€as€permitting€someÏflexibility€concerning€amendment€of€the€schedule.€€The€commentsÏreceived€regarding€this€issue€support€the€interpretation€that€theÏEPA€has€the€authority€to€amend€the€schedule,€and€to€retain€someÏregulatory€flexibility,€after€publication€of€today's€schedule.€ÏThe€EPA€considers€it€impractical€to€have€a€strictly€rigidÏschedule€for€the€reasons€discussed€in€section€I.B.€of€today'sÏnotice.€€To€reiterate€some€of€these€reasons,€as€new€data€becomeÏavailable,€the€EPA€may€identify€changes€to€the€schedule€thatÏwould€facilitate€greater€achievement€of€the€prioritizing€criteriaÏof€section€112(e).€€As€pointed€out€by€some€commenters,€there€mayÏbe€situations€where€significant€new€information€is€obtainedÏ(e.g.,€data€indicating€that€a€source€category€presents€much€lessÏof€a€hazard€to€public€health€than€previously€thought,€or€theÏdiscovery€that€a€source€category€is€posing€a€significant€threatÏto€the€environment)€that€warrants€limited€changes€to€theÏschedule.€€In€addition,€amendment€of€the€schedule€may€also€beÏnecessary€if€categories€on€the€initial€source€category€list€areÏdelisted€under€the€authority€of€section€112(c)(9).€€Hence,€theÏEPA€anticipates€that€it€may,€from€time€to€time,€amend€theÏschedule€for€standards€published€in€today's€notice.Ìà  àThe€EPA€does€not€anticipate€frequent€amendment€of€theÏschedule€for€standards€for€important€reasons.€€First,€because€ofÏthe€long€lead€time€and€significant€resources€required€toÏpromulgate€an€emissions€standard,€the€EPA€will€not€have€theÏtechnical€ability€or€resources€to€reschedule€many€standards,Ïparticularly€to€move€significant€numbers€of€source€categoriesÐ Ðinto€earlier€timeframes.€€Second,€because€of€the€section112(e)Ïnumerical€and€temporal€requirements€regarding€scheduling€ofÏstandards€(e.g.,€regulate€25€percent€of€all€listed€sourceÏcategories€by€November€15,€1994,€and€an€additional€25€percent€byÏNovember€15,€1997),€the€EPA€is€limited€in€its€ability€to€deferÏcategories€into€later€timeframes€without€moving€a€commensurateÏnumber€of€standards€to€earlier€timeframes.€€Ìà  àOne€commenter€stressed€that€it€is€incorrect€to€hasten€theÏregulatory€schedule€for€categories€for€which€information€is€moreÏreadily€available€just€because€they€are€easier€to€regulate€in€aÏgiven€timeframe,€notwithstanding€the€impact€of€their€emissions€onÏpublic€health.Ìà  àOne€commenter€reiterated€concerns€they€had€expressed€inÏtheir€comments€on€the€preliminary€draft€list€of€source€categoriesÏregarding€the€approach€the€EPA€used€to€identify€which€sourcesÏfell€under€which€categories€and€their€respective€schedules.€€TheÏcommenter€questioned€why€butyl€benzyl€phthalate,€a€phthalateÏplasticizer,€is€included€in€the€draft€list€of€SOCMI€processesÏ(scheduled€for€MACT€promulgation€by€November15,€1992).€€ThisÏwould€result€in€butyl€benzyl€phthlate€production€being€regulatedÐ D-ø&/ Ðbefore€the€phthalate€plasticizers€production€source€categoryÏlisted€under€miscellaneous€processes.€€The€commenter€questionedÏthe€logic€of€requiring€regulation€of€one€phthalate€plasticizerÏ8years€before€the€others.€€In€addition,€the€commenter€indicatedÏthat€the€EPA€had€not€specified€which€category€the€formaldehydeÏresins€group€would€fall€under,€stating€that€it€could€fit€underÏthe€acetal€resins€production,€the€amino€resins€production,€or€theÏphenolic€resins€production€categories.Ìà  àAnother€commenter€alleged€that€little€reliable€quantitativeÏdata€on€emissions€of€HAP's€from€iron€or€steel€foundries€wereÏpresented.€€They€stated€that€due€to€different€emissions,€process,Ïand€technology€characteristics,€iron€foundries€and€steelÏfoundries€should€not€be€assigned€the€same€regulatory€schedule€asÏother€sources€grouped€in€the€ferrous€metal€processing€industryÏgroup.€€The€commenter€requested€a€November15,€2000€scheduleÏassignment.Ìà  àIn€response€to€these€comments,€section€112(e)(2)(C)€allowsÏthe€EPA€to€prioritize€regulations€for€source€categories€based€onÏ"the€efficiency€of€grouping€categories...€according€to€theÏpollutants€emitted,€or€the€processes€or€technologies€used."€€ThisÏcriterion€enables€the€EPA€to€more€effectively€utilize€itsÏtechnical€resources€for€developing€regulations,€and€helps€preventÏthe€EPA€from€duplicating€regulatory€efforts€for€similarÏcategories.€€The€EPA€has€considered€in€the€past,€and€willÏconsider€in€the€future,€characteristics€such€as€end€products,Ïprocessing€steps,€raw€materials,€emitted€pollutants,€emissionÏcontrols,€economic€factors,€and€efficiency€of€using€EPA€resourcesÏin€grouping€source€categories€into€single€regulatory€projects.€ÏOf€course,€without€extensively€studying€each€source€category,€itÏis€often€difficult€for€the€EPA€to€predict€whether€a€particularÏemission€standard€will€closely€resemble€a€standard€for€anotherÏsource€category.€€The€EPA€understands€that€if€it€is€laterÏdiscovered€that€initially€grouped€categories€may€not€effectivelyÏbe€regulated€by€one€standard,€the€EPA€may€promulgate€separateÏstandards€for€the€source€categories€as€necessary.€€However,€toÏfollow€the€commenter's€suggestion€of€continuing€to€have€projectÏgroupings€for€similar€categories€but€then€to€promulgate€eachÏemission€standard€at€different€times€based€on€the€SCRS€rankingÏwould€defeat€the€purpose€of€the€efficiency€of€grouping€criteriaÏand€could€have€a€substantial€impact€on€the€EPA€meeting€otherÏgoals€of€section€112.Ìà  àThe€EPA€investigated€the€commenter's€allegation€that€theÏpolyester€resins€production€is€identical€to€polyethyleneÏterephthalate€production.€€This€review€revealed€that€theseÏcategories€are€in€fact€distinct€from€one€another,€and€shouldÏremain€as€separate€source€categories.€€In€particular,Ïpolyethylene€terephthalate€is€an€ethylene€glycol„based€polymerÏwhich€is€spun€into€fibers€for€clothing,€blow„molded€into€plasticÏbottles,€or€quenched€and€stretched€to€form€specialty€films.€Ð  .À'0 ÐPolyester€resins,€on€the€other€hand,€are€styrene„based€resinsÏthat€are€used€primarily€in€the€manufacture€of€fiberglass.€ÏBecause€of€these€differences,€there€is€no€technical€reason€toÏschedule€the€two€source€categories€in€the€same€timeframe.€€TheÏpolyester€resins€production€source€category€has€been€moved€to€theÏ10„year€timeframe.€€And,€the€polyethylene€terephthalateÏproduction€source€category€remains€scheduled€in€the€4„yearÏtimeframe.€€The€reader€is€referred€to€section€IV€of€today'sÏnotice€for€further€discussion€of€the€changes€to€the€draftÏschedule.Ìà  àIn€response€to€the€comments€regarding€the€formaldehydeÏresins€group,€this€is€merely€a€title€that€has€been€adopted€by€theÏEPA€to€refer€to€the€NESHAP€project€intended€to€regulate€theÏacetal,€amino,€and€phenolic€resins€production€source€categories.€ÏBy€researching€these€individual€categories,€the€EPA€discoveredÏthat€each€of€these€resin€producers€used€formaldehyde€as€aÏprincipal€reactant€in€the€polymerization€reaction.€€Consequently,Ïthe€EPA€decided€to€minimize€its€regulatory€resource€efforts€byÏgrouping€these€three€source€categories€into€one€project.€ÏAlthough€the€same€regulatory€project€focuses€on€all€threeÏcategories,€this€does€not€necessarily€suggest€that€the€emissionÏstandards€will€be€equivalent.€€However,€it€means€that€informationÏwill€be€gathered€simultaneously,€that€Agency€work€groupÏmembership€will€presumably€be€similar€(if€not€identical),€andÏthat€the€emission€standard(s)€will€most€likely€be€proposed€andÏpromulgated€on€the€same€schedules.Ìà  àIn€response€to€a€commenter's€concerns€regarding€butyl€benzylÏphthalate,€the€production€of€butyl€benzyl€phthalate€is€includedÏin€the€list€of€SOCMI€processes€which€are€proposed€for€regulationÏunder€the€HON€(57€FR€62608;€December€31,€1992).€€It€is€includedÏin€the€list€of€SOCMI€processes€because€butyl€benzyl€phthalateÏfits€the€definition€delineated€in€the€proposed€HON.€€The€otherÏphthalate€plasticizers€do€not€meet€the€HON€definition.€ÏTherefore,€the€other€phthalate€plasticizers€productions€areÏgrouped€into€a€separate€category€of€major€sources€and€were€rankedÏseparately€in€the€SCRS.€€They€ranked€relatively€low€in€the€SCRSÏand€were€scheduled€in€the€10„year€timeframe.€€The€list€of€SOCMIÏprocesses€is€not€an€item€for€review€under€this€action.€€However,Ïthe€comment€has€been€forwarded€to€the€EPA€staff€responsible€forÏthe€proposed€HON.€€Ìà  àRegarding€the€comment€on€the€iron€foundries€and€steelÏfoundries€source€categories,€these€categories€were€scheduledÏindependently€of€the€other€categories€within€the€ferrous€metalsÏprocessing€industry€group.€€However,€after€further€review€by€theÏEPA,€the€iron€foundries€and€steel€foundries€source€categoriesÏhave€been€moved€to€the€10„year€timeframe.€€In€consideration€ofÏregulatory€efficiency,€individual€source€categories€within€theÏâ âferrous€metals€industry€group€may€subsequently€be€grouped€withÐ 8-ì&/ Ðone€or€more€other€similar€categories€within€or€outside€of€theÏindustry€group.Ìâ
