THREE MEN CHARGED IN NEVADA PLATING WASTE CASE

Gene Moran, former owner and operator of the defunct Silver State Plating facility in Las Vegas, Nev., and two former employees, John Moran and John Gold, were indicted on Sept. 15, in U.S. District Court in Las Vegas on charges of conspiracy, for allegedly violating the Clean Water Act and for allegedly making false statements. Each defendant is charged with multiple violations. The indictment alleges that the defendants knowingly discharged metal plating wastes that were characteristic for high pH and contained toxic pollutants including chromium, cadmium and lead into the city of Las Vegas sewer system and into Las Vegas Wash from about February 1996 to about January 1998. Water which is high in pH can cause burns and can damage sewage treatment equipment, and water which has high concentrations of chromium, cadmium and lead can cause a variety of neurological and other illnesses. If convicted, each defendant faces maximum sentences of up to five years in prison and/or a fine of up to $250,000 on each count of conspiracy and false statements and up to three years in prison and/or a fine of up to $250,000 on each Clean Water Act charge. The case was investigated by EPA’s Criminal Investigation Division with the assistance of EPA’s National Enforcement Investigations Center, the Nevada Department of Environmental Protection, the Clark County Sanitation District, and is being prosecuted by the U.S. Department of Justice.
