EPA is providing notice of a proposed administrative penalty settlement with the City of Lynnwood (respondent) for violations of the Clean Water Act at its wastewater facility located in Edmonds, Washington.
EPA alleges that the respondent failed to submit timely permit and compliance schedule reports, and failed to meet effluent limits for total suspended solids and carbonaceous biological oxygen demand as required by their National Pollutant Discharge Elimination System permit (#WA0024031).
This action is being simultaneously commenced and concluded in a legal document called an Expedited Settlement Agreement. Under the proposed agreement (see "Related Documents" below), the City of Lynnwood will pay a civil penalty of $4,350 and has returned to compliance.
