Public Notice: Proposed Settlement with Darigold, Inc. for Clean Water Act Violations in Caldwell, Idaho
Summary
EPA is providing notice of a proposed administrative penalty settlement with Darigold, Inc. (respondent) for violations of the Clean Water Act at its facility located in Caldwell, Idaho.
EPA alleges that the respondent failed to comply with its individual National Pollutant Discharge Elimination System (NPDES) Permit and Multi-Sector General Permit (MSGP). Both permits cover discharges of pollutants into the Boise River.
Alleged violations under the individual NPDES permit include effluent limit violations and an inadequate Quality Assurance Plan. Alleged violations under the MSGP include unauthorized discharges, inadequate control measures, failure to conduct a routine inspection during a stormwater discharge, inadequate corrective actions, inadequate Stormwater Pollution Prevention Plan, failure to monitor all outfalls, and failure to take representative samples.
This action is being simultaneously commenced and concluded in a legal document called a Consent Agreement and Final Order. Under the proposed agreement (see "Related Documents" below), Darigold, Inc., will pay a civil penalty of $318,000.
